These Terms of Service govern your use of the KELVO website, online store, products, content, features, tools and related services (collectively, the “Services”).

KELVO is operated by Stripz Ecom MB, a company registered in Lithuania under company registration number 307489582. Throughout these Terms, the terms “KELVO,” “we,” “us” and “our” refer to Stripz Ecom MB, trading under the KELVO brand.

Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using our Services.

Please read these Terms carefully. They contain important information regarding your legal rights, purchases, warranties and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you should not use the Services.

Nothing in these Terms limits any mandatory consumer rights or protections that apply to you under applicable law.

SECTION 1 - ACCESS AND ACCOUNT

By using the Services, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you. If you permit a minor to use the Services, you are responsible for their use to the extent permitted by applicable law.

When using our Services or making a purchase, you may be asked to provide information such as your name, email address, billing information, payment details and shipping address.

You agree to provide information that is accurate, current and complete and that you have the necessary right to provide.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You may not sell, transfer or assign your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to display and describe our products accurately.

However, product colors and appearance may vary slightly depending on your device, screen settings, lighting conditions and other factors.

Product images may include lifestyle photography, illustrations or other visual representations intended to demonstrate the product. Minor differences in appearance, packaging or presentation may occur.

Product descriptions, specifications, prices and availability may be updated from time to time.

We reserve the right to modify or discontinue products and to limit quantities available to a particular customer, geographic region or jurisdiction where reasonably necessary.

Nothing in this section affects your statutory rights relating to products that are defective, damaged, incorrectly supplied or otherwise non-conforming under applicable consumer law.

SECTION 3 - ORDERS

When you place an order through KELVO, you are making an offer to purchase the selected products.

An order is accepted when we confirm acceptance or otherwise process the order in accordance with our checkout process.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of suspected fraud, payment problems, incorrect pricing, stock availability, suspected resale activity or other legitimate reasons.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

Please review your order carefully before completing your purchase.

If you need to change or cancel an order, contact support@kelvoband.com as soon as possible. We will make reasonable efforts to accommodate your request before fulfillment begins, but we cannot guarantee changes or cancellations once an order has entered processing or has been dispatched.

Purchases are also subject to our Refund Policy, including our 100-day money-back guarantee.

Unless otherwise agreed, products purchased through our consumer store are intended for personal or household use and not for unauthorized commercial resale.

SECTION 4 - PRICES AND BILLING

Product prices, discounts and promotions may change from time to time.

The price applicable to your purchase is the price displayed during checkout when your order is placed, subject to correction of obvious errors as permitted by applicable law.

Any applicable taxes, shipping charges or other charges will be displayed or communicated during checkout where required.

For international orders, customs duties, import taxes or similar charges may apply depending on the destination country. Unless expressly stated otherwise at checkout, such charges may be the responsibility of the recipient.

Promotional offers may be subject to additional terms. If specific promotional terms conflict with these Terms regarding that promotion, the specific promotional terms will apply to the extent of that conflict.

You agree to provide accurate and complete billing and payment information and confirm that you are authorized to use the payment method provided.

SECTION 5 - SHIPPING AND DELIVERY

We aim to dispatch orders within 1 business day.

Typical delivery is approximately 3–7 working days after dispatch, depending on the destination and shipping service. Delivery estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather, public holidays or other disruptions.

We will provide tracking information when available.

Nothing in this section excludes or limits any rights you may have regarding delivery under mandatory consumer law.

SECTION 6 - RETURNS AND REFUNDS

KELVO provides a 100-day money-back guarantee, subject to our Refund Policy.

You have 100 days after receiving your order to request an eligible return.

Opening or reasonably trying a KELVO product does not automatically make it ineligible for return under our guarantee. This includes products such as Mouth Tape, Nasal Strips and Sleep Earplugs.

Products purchased during sales and promotions are also eligible under our 100-day return policy unless expressly identified as non-returnable before purchase.

Our voluntary 100-day guarantee does not restrict any statutory rights you may have under applicable consumer law.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and their content, including KELVO branding, trademarks, logos, product names, product designs, photographs, graphics, text, videos, audio, website design and other original content, are owned by or licensed to Stripz Ecom MB and are protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial purposes.

Unless permitted by applicable law or authorized by us in writing, you may not reproduce, distribute, modify, republish, commercially exploit or create derivative works from our protected content.

“KELVO,” its logos, branding and associated product or service identifiers may constitute trademarks or other protected intellectual property of Stripz Ecom MB or its licensors.

Shopify's names, trademarks and logos belong to Shopify or its respective affiliates.

Nothing in these Terms transfers ownership of our intellectual property to you.

SECTION 8 - OPTIONAL TOOLS

We may provide access to tools, applications or functionality supplied by third parties.

We may not control or monitor those third-party services. Your use of them may therefore also be subject to the relevant third party's terms and privacy practices.

To the extent permitted by law, we are not responsible for third-party tools or services that are outside our reasonable control.

We may introduce additional tools, functionality or features in the future. Unless otherwise stated, those features form part of the Services and are subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

Our Services may contain links to third-party websites, platforms or services.

We do not necessarily control or endorse third-party websites and are not responsible for their content, availability, security or practices.

If you choose to visit or transact with a third party, you should review that party's terms, privacy policy and other applicable policies.

Nothing in this section limits liability that cannot lawfully be excluded.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

KELVO is powered by Shopify, which provides ecommerce infrastructure that enables us to operate our online store.

However, purchases made from the KELVO store are transactions directly between you and Stripz Ecom MB, trading as KELVO.

Shopify is not the seller of KELVO products.

Your use of Shopify-related functionality may also involve processing of information by Shopify as described in applicable privacy notices.

SECTION 11 - PRIVACY

Our collection and processing of personal information through the Services is described in our Privacy Policy.

Because our store is powered by Shopify, certain information may also be processed by Shopify and other service providers that help us operate our store, process transactions, deliver orders and provide customer support.

Please review our Privacy Policy for more information about how your personal information is collected, used, shared and protected.

SECTION 12 - REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit reviews, feedback, suggestions, photographs, videos or other content to KELVO, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute that content for purposes connected with operating, improving and promoting KELVO and our Services, subject to applicable law.

You confirm that you have the necessary rights to content you submit and that your submission does not violate another person's intellectual property, privacy or other rights.

If you received compensation, a free product, discount or another incentive in connection with submitting content, you must disclose this where required by applicable law.

You may not submit content that is unlawful, fraudulent, defamatory, abusive, obscene, malicious or infringes the rights of another person.

You must not impersonate another person or intentionally misrepresent the origin of a review or other submission.

We may moderate or remove user-submitted content where reasonably necessary, including where it violates these Terms or applicable law.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.

We may correct errors and update information when discovered.

Where an error affects an order you have already placed, we will handle the situation in accordance with applicable law and, where appropriate, contact you before taking further action.

SECTION 14 - PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use the Services to violate applicable law; infringe intellectual property or other rights; transmit malware or malicious code; conduct fraudulent activity; impersonate another person or organization; harass or harm another person; collect personal information unlawfully; send spam or unauthorized solicitations; interfere with the operation or security of the Services; circumvent access or security restrictions; or otherwise use the Services in a manner that could reasonably harm KELVO, our customers, Shopify or third parties.

You must not systematically scrape, extract, reproduce or commercially exploit our website or its content without authorization, except where such restriction would be prohibited by applicable law.

We may restrict or terminate access to the Services where we reasonably believe these Terms have been materially violated.

SECTION 15 - AUTOMATED SYSTEMS AND AGENTS

Automated systems, bots, agents and similar technologies must not access or interact with the Services in a manner that circumvents technical restrictions, security measures or instructions designed to regulate automated access.

Automated systems must not conceal their automated nature, circumvent CAPTCHAs or other security mechanisms, or access the Services for unlawful or abusive purposes.

We may use reasonable technical measures to manage or restrict automated access to our Services.

SECTION 16 - TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access to the Services where reasonably necessary, including where you materially violate these Terms, engage in fraudulent or abusive conduct, interfere with the Services or create security or legal risks.

Termination does not affect rights or obligations that arose before termination.

Provisions that by their nature should continue after termination, including provisions concerning intellectual property, liability, user content and governing law, will continue to apply.

SECTION 17 - WARRANTIES AND CONSUMER RIGHTS

We aim to provide accurate information and products that conform to their descriptions.

To the extent permitted by applicable law, information provided through the Services is provided for general informational purposes and we do not guarantee that all website content will always be complete, current or error-free.

Nothing in these Terms excludes, restricts or overrides any warranty, guarantee, remedy or consumer right that cannot legally be excluded or limited.

Where mandatory consumer protection law applies, those rights take precedence over any conflicting provision of these Terms.

SECTION 18 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, KELVO and Stripz Ecom MB will not be liable for indirect, incidental, special or consequential losses arising from your use of the Services where such liability may lawfully be excluded.

We are not responsible for losses caused solely by circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.

Your statutory consumer rights remain unaffected.

SECTION 19 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Stripz Ecom MB, KELVO and their respective employees, contractors and service providers from third-party claims, losses or reasonable costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights.

Nothing in this section imposes obligations on a consumer that cannot lawfully be imposed under applicable consumer protection law.

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, severed from these Terms.

The remaining provisions will continue in effect.

SECTION 21 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement governing your use of the Services and purchases from KELVO, subject always to rights that cannot be excluded by law.

SECTION 22 - ASSIGNMENT

You may not assign your rights or obligations under these Terms where doing so would materially affect our rights or obligations without our prior written consent.

We may assign or transfer our rights and obligations in connection with a reorganization, sale, transfer of business or similar transaction, subject to applicable law and without reducing your statutory rights.

SECTION 23 - GOVERNING LAW

These Terms and any separate agreements through which we provide the Services are governed by the laws of the Republic of Lithuania.

Any disputes will be subject to the jurisdiction of the competent courts of Lithuania, except where mandatory consumer protection rules give you the right to bring proceedings or rely on protections in another jurisdiction.

If you are a consumer residing in another European Union or European Economic Area country, nothing in these Terms deprives you of mandatory consumer protections available to you under the laws applicable to your place of residence.
